StylHive Terms of Use

Translation. In the event of any discrepancy, only the French version is legally binding.

Version 2026-10-11 — effective from the date of their publication.

1. Purpose

These general terms of use (the “Terms”) govern the use of StylHive, an apiary management application available on Android and on the web at app.stylhive.com (the “Service”), published by the person identified as the controller in the privacy policy (the “Publisher”).

Together with the data processing annex that supplements them and the privacy policy to which they refer, they form the agreement between the Publisher and each person who creates an account (the “User”).

2. Definitions

3. Acceptance

Opening an Account requires express acceptance of these Terms, by means of a tick box that is never pre-ticked. The version accepted and the date of acceptance are recorded.

Any substantial change to the Terms is brought to the User’s attention in the application before it takes effect, and requires renewed acceptance in order to continue using the Service. A User who does not accept it may delete their Account, after exporting their Data.

4. Who may open an Account

The Service is open to persons aged fifteen or over. By accepting these Terms, the User declares that they are of that age. A younger child taking part in a teaching apiary does not open an Account: entries concerning them are made by a supervisor, under that supervisor’s Account.

An Account is personal. The User keeps their login details confidential and informs the Publisher without delay if they suspect that a third party knows them.

5. Description of the Service and free use

StylHive helps beekeepers keep track of their colonies: apiaries, hives, colonies, queens, inspections, interventions, seasonal reminders, and the production of a livestock register (registre d’élevage) from the entries made. The Service works without a network connection and synchronises as soon as the connection returns.

The Service is free of charge. The Publisher may introduce a paid offer, for example beyond a certain number of hives, subject to two months’ notice. Free use in the past creates no right to free use in the future; no sum will ever be payable for a period that has already elapsed.

6. What the Publisher undertakes to do, and what it does not

StylHive is first and foremost a free service, built to be useful. The Publisher brings all reasonable care to it — this is an obligation of means (obligation de moyens), not an obligation to achieve a result (obligation de résultat) — within the following limits:

  1. Availability. The Service comes with no commitment as to availability, restoration time or service level. It may be interrupted, degraded or suspended, in particular in the event of an incident, maintenance or the failure of a service provider.
  2. Defects. The application may contain errors. The Publisher corrects them as its resources allow.
  3. Advice. The seasonal reminders and all information displayed are configurable reminders. They constitute neither veterinary advice, nor animal health advice, nor technical advice. The User remains the sole judge of how they manage their colonies and of the treatments they administer.
  4. Regulatory obligations. StylHive helps keep a livestock register. The Publisher does not guarantee that the document produced will pass an inspection, nor that the User’s reporting obligations are fulfilled: keeping the register, its accuracy and its retention, as well as mandatory declarations (in particular the annual declaration of hives), remain the sole responsibility of the beekeeper. Documents that the register requires to be attached (prescriptions, invoices, analyses, etc.) are not stored by the Service.
  5. Backup. The Publisher backs up data regularly, but does not guarantee the restoration of lost data. A complete export of the Data is free, unlimited and available at any time: Users are advised to use it regularly. Entries made without a network connection and not yet sent exist only on the device on which they were made; the application indicates this.
  6. Changes and discontinuation. The Publisher may change the Service for technical, security or regulatory reasons, or to improve it. If a change significantly reduces a feature in use, the User is informed at least thirty days in advance and may, if they do not accept it, delete their Account after exporting their Data. The Publisher may also discontinue the Service, subject to two months’ notice given in the application and by email, during which everyone may export their Data.

7. Liability

The Publisher is liable for any failure to perform the obligations defined in article 6, under the conditions of ordinary law.

It is not liable for damage resulting from the management of colonies and from animal health decisions, which are for the beekeeper to take; from inaccuracy in the Data entered by the User or by the members of their operation; from an event of force majeure; or from any use of the Service contrary to these Terms.

Nothing in these Terms excludes or limits its liability in the event of fraud (dol), gross negligence (faute lourde) or personal injury, nor the rights that the law grants to consumers on a mandatory basis.

8. User obligations

The User undertakes:

9. Operation, members and roles

The owner of an operation invites members to it, by means of a link valid for forty-eight hours, with the role of beekeeper (who enters data) or viewer (who views it). The owner may remove a member at any time, and hand over ownership of the operation to a beekeeper who is a member of it: the owner then leaves it, and the new owner becomes its controller from then on.

A member’s entries bear their name and remain attributed to them within the operation after they leave: this is required for the traceability of the livestock register. The member is informed of this before joining the operation.

For the Data of their operation, the owner is the controller within the meaning of Regulation (EU) 2016/679 (the “GDPR”); the Publisher acts as their processor, under the conditions of the annex below. For the Data of their own Account (identity, email address, language, consents), the Publisher is the controller for each User, as explained in the privacy policy.

10. Ownership

The code, the StylHive name, its logos, its texts and its illustrations belong to the Publisher. Their reproduction outside the normal use of the Service is not authorised.

The Data belongs to the User. The User authorises the Publisher to store, reproduce and display it solely for the purpose of providing the Service. The Publisher does not sell or transfer it, and does not use it for any purpose other than providing and improving the Service, in the form of statistics containing neither names nor locations. The User may export it whenever they wish, in an open format.

As with any hosted service, the Publisher, as administrator, has technical access to the Data. It undertakes not to consult the Data of an operation except: where its owner grants access to support from within the application (read-only, for seventy-two hours at most, revocable); to the extent strictly necessary to restore the Service, or to restore or erase Data; or at the request of a legally authorised authority.

11. Term, suspension and termination

These Terms apply for as long as the Account exists.

The User may delete their Account at any time from the application or from the web. An export is offered to them beforehand. If the Account is the sole owner of an operation in which other members work, deletion first requires ownership to be handed over. Deletion takes effect immediately for the User; permanent erasure takes place within thirty days, the encrypted backups being destroyed on rotation within six months.

The Publisher may suspend or close an Account in the event of a serious breach of these Terms, after formal notice has remained without effect for fifteen days, except in an emergency relating to the security of the Service or of others. Reasons for any suspension are given in writing. The User retains the ability to export their Data for thirty days.

An Account that has not been logged into for three years is deleted, after a warning sent to its email address one month beforehand.

12. Personal data

The processing of personal data is described in the privacy policy, available from within the application and without an Account. The Publisher’s commitments as processor for the owner of an operation are set out in the data processing annex below.

13. Governing law and disputes

These Terms are governed by French law, without prejudice to the mandatory provisions of the law of the country in which the consumer User is habitually resident.

In the event of any difficulty, the User is invited first to write to the Publisher, at the address given in the legal notice: most difficulties are resolved in this way. Failing agreement, the dispute shall be brought before the competent courts in accordance with the ordinary rules; a consumer User may, at their choice, bring proceedings before the court for the place where they resided at the time the contract was concluded or the harmful event occurred.

Once a paid offer exists, the Publisher will name the consumer mediator (médiateur de la consommation) to whom the consumer User may refer a dispute free of charge.

Annex — Data Processing Agreement (Article 28 GDPR)

A.1 Parties and subject matter

This annex binds the owner of an operation (the “Controller”) and the Publisher (the “Processor”), insofar as the Controller is subject to the GDPR — which is not the case for a beekeeper who keeps their apiary purely as a hobby. It applies to the personal data that the Controller and the members of their operation enter into the Service, and that the Publisher processes on their behalf.

For its own purposes — security of the Service, backups, usage statistics without names or locations — the Publisher acts as controller, under the conditions of the privacy policy.

A.2 Description of the processing

A.3 Instructions

The Processor processes the data only on the documented instructions of the Controller, including with regard to transfers outside the European Union. These Terms and the Controller’s use of the Service (entering, modifying, inviting, exporting, deleting) constitute those instructions. If, in the Processor’s opinion, an instruction infringes the GDPR, the Processor informs the Controller.

A.4 Confidentiality

The Processor ensures that persons authorised to process the data have committed themselves in writing to confidentiality. As administrator, it has technical access to the data, and undertakes to consult the data of an operation only: where the Controller grants it access from within the application (read-only, for seventy-two hours at most, revocable, and never including the location of apiaries or the list of members); to the extent strictly necessary to restore the Service, or to restore or erase data; or at the request of a legally authorised authority.

A.5 Security

The Processor implements the measures required by Article 32 GDPR, in particular: encryption of data in transit and of data at rest with the hosting provider; access rules enforced by the server that isolate each operation and each role; apiary locations held in a separate document, closed by default to viewers and to support; verification of the authenticity of the application (App Check); encrypted backups stored offline.

A.6 Sub-processors

The Controller gives general authorisation for the use of the sub-processors listed in the privacy policy, in particular Google Ireland Limited (hosting of the database in Paris, authentication, delivery of the website) and, for technical data only and subject to each user’s consent, Google LLC. The Processor informs the Controller of any addition or replacement, by a notice in the application and by email at least thirty days in advance, so that the Controller may object by ceasing to use the Service and exporting their data. It imposes on each sub-processor obligations equivalent to those of this annex.

A.7 Assistance to the Controller

The Processor assists the Controller, insofar as possible:

It notifies the Controller of any personal data breach concerning their operation without undue delay, and at the latest within forty-eight hours of becoming aware of it, with the information available.

A.8 End of processing

When the operation is deleted, the Controller retrieves their data by means of the export (complete, in an open format, available at any time up to the last day); the Processor then erases it: immediate logical erasure, permanent erasure within thirty days, and destruction of encrypted backups on rotation within six months. It keeps no copy beyond that, unless required by law.

A.9 Documentation and audit

The Processor makes available to the Controller the information necessary to demonstrate compliance with this annex, and allows audits to be carried out by the Controller or by an auditor mandated by the Controller, upon a reasoned request, with reasonable notice, without access to the data of other operations. The costs of the audit, including the auditor’s fees, are borne entirely by the Controller; the Processor bears none of them. The documentation of the security measures and of the hosting provider’s sub-processors is that published by Google.

A.10 Record

The Processor maintains the record of categories of processing activities carried out on behalf of controllers, as provided for in Article 30(2) GDPR.
